These Terms and Conditions ("Terms") govern your access to and use of the website operated by Solarize New England ("SolarizeNE," "we," "us," or "our") at solarizene.com, as well as any related services we provide. By accessing or using our website and services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website, submitting a quote request, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our website or services.

We reserve the right to modify these Terms at any time. Your continued use of our website following any modifications constitutes your acceptance of the revised Terms.

2. Description of Services

SolarizeNE operates as a solar brokerage company serving homeowners and businesses across Massachusetts, Connecticut, Rhode Island, New Hampshire, and Maine. Our services include:

  • Connecting homeowners and property owners with vetted, qualified solar installation companies
  • Providing solar savings estimates and system sizing recommendations
  • Facilitating the comparison of solar installation quotes from multiple providers
  • Offering educational resources about solar energy, incentives, and financing options

Important: SolarizeNE is a solar brokerage and is not a solar installer. We do not directly install solar panels, perform electrical work, or provide construction services. We act as an intermediary connecting you with qualified third-party solar installation professionals.

3. Quote Accuracy and Disclaimer

Solar quotes, savings estimates, and system recommendations provided through our website and services are estimates only and are based on the information you provide along with publicly available data. Actual costs, savings, system sizes, and installation timelines may vary based on factors including but not limited to:

  • Actual property and roof conditions assessed during a site survey
  • Changes in equipment pricing, availability, or specifications
  • Local permitting requirements and utility interconnection processes
  • Changes in federal, state, or local incentive programs
  • Individual financing terms and credit qualifications
  • Utility rate changes and net metering policy updates

SolarizeNE does not guarantee any specific savings, costs, or return on investment. All final pricing, system specifications, and contractual terms are determined by the solar installer you select and are subject to a formal agreement between you and that installer.

4. User Responsibilities

By using our website and services, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into binding agreements.
  • You are the homeowner or authorized representative of the property for which you are requesting solar information.
  • All information you provide to us is accurate, current, and complete.
  • You will promptly update any information that changes.
  • You will not use our website for any unlawful or prohibited purpose.
  • You will not attempt to interfere with the proper functioning of our website.

5. Intellectual Property

All content on the SolarizeNE website — including but not limited to text, graphics, logos, images, software, and the overall design and layout — is the property of Solarize New England or its content suppliers and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, modify, display, perform, or otherwise use any content from our website without our prior written consent, except for personal, non-commercial use related to evaluating our solar brokerage services.

6. Limitation of Liability

As a solar brokerage, SolarizeNE facilitates connections between homeowners and solar installers. You acknowledge and agree that:

  • SolarizeNE is not responsible for the quality, safety, legality, or timeliness of any installation work performed by third-party solar installers.
  • SolarizeNE has no control over the actions, services, or products of the solar installers in our network.
  • Any contractual agreement for solar installation is between you and the installer, not SolarizeNE.
  • SolarizeNE shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, or from any installation performed by a third-party installer.

While we carefully vet the installers in our network, we do not guarantee or warrant the performance of any third-party installer. We encourage you to perform your own due diligence before entering into any agreement with a solar installer.

To the maximum extent permitted by applicable law, SolarizeNE's total liability to you for any claims arising from or related to our services shall not exceed the amount you paid to SolarizeNE, if any, during the twelve (12) months preceding the claim.

7. Third-Party Links and Services

Our website may contain links to third-party websites, services, or resources that are not owned or controlled by SolarizeNE. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that SolarizeNE shall not be responsible or liable for any damage or loss caused by or in connection with your use of or reliance on any third-party content, goods, or services available through such websites.

8. Privacy Policy

Your use of our website and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the practices described in our Privacy Policy.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the Commonwealth of Massachusetts, and you hereby consent to the personal jurisdiction of such courts.

10. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or in a court of competent jurisdiction in the Commonwealth of Massachusetts.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

11. Modifications to Terms

SolarizeNE reserves the right to revise, update, or otherwise modify these Terms at any time and at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of these Terms and post the revised version on our website.
